King’s Leisure & Travel · Updated June 2025

The following terms apply to travel products and services purchased through King’s Leisure & Travel, including Rally Escapes. Please review them carefully before booking or submitting payment.

RESERVATIONS

IDENTIFICATION: Guests are required to make reservations using the full legal name listed on the government-issued identification or passport that will be used for travel. Travelers are responsible for ensuring that their names and personal information are correct on all invoices and travel documents. If a name must be changed after travel documents have been issued, the traveler will be responsible for all applicable King’s Leisure & Travel and supplier-imposed name change fees.

DEPOSITS: A deposit is due at the time of reservation unless otherwise specified. All deposits are non-refundable and non-transferable. There are no exceptions to this deposit policy. All reservations, except where otherwise specified, require a deposit. The deposit amount and applicable payment schedule will be clearly stated at the time of booking.

TRAVEL DOCUMENTS

PASSPORTS AND VISAS: Travelers are responsible for ensuring that they possess all required travel documentation and must check with the appropriate consulate, embassy, visa agency, or official government authority to determine whether passports, visas, entry authorizations, vaccinations, or other documentation are required.

Passports should generally remain valid for at least six months beyond the scheduled date of travel. Some countries may also require a full blank visa page in the passport for stamping purposes.

Any entry requirement information provided by King’s Leisure & Travel pertains to U.S. citizens unless otherwise stated. Non-U.S. citizens are responsible for checking with the appropriate consulate or government authority for current entry requirements. King’s Leisure & Travel does not provide or validate entry requirements for non-U.S. citizens.

King’s Leisure & Travel strongly recommends that all cruise passengers travel with a valid passport.

In accordance with TSA and supplier requirements, travelers may be required to provide their full legal name as it appears on their passport or identification, date of birth, gender, address, and contact information. Travelers are responsible for ensuring that the information appearing on their invoices and travel documents is accurate. King’s Leisure & Travel will not be responsible for travelers who are denied boarding, experience delays, or incur additional expenses due to inaccurate information.

CHILDREN: All children under the age of 18 must be accompanied by an adult. Accompanying adults are responsible for the safety and supervision of children traveling with them.

Many countries have adopted requirements intended to prevent the international abduction of minors. If a traveler under the age of 18 is traveling with an adult other than their parent or legal guardian, or is traveling with only one parent, a notarized letter from the parent, guardian, or non-traveling parent authorizing travel may be required. Travelers are responsible for determining the documentation required for minors before departure.

PAYMENTS, CHANGES & CANCELLATIONS

PAYMENTS: All reservations may be paid in full at the time of booking. If a reservation is not paid in full, installment payments are required according to the payment schedule provided with the reservation.

Reservations with payments that remain overdue for 30 days may be automatically canceled without refund and all deposits and prior payments may be forfeited. If final payment is not made by the applicable due date, the reservation may be canceled and all payments previously made may be forfeited.

FULL PAYMENT: Reservations may be paid in full at the time of booking provided space remains available.

REFUNDS: All payments made to King’s Leisure & Travel are non-refundable and non-transferable unless expressly stated otherwise in writing.

King’s Leisure & Travel enters into contractual agreements with hotels, resorts, airlines, cruise lines, transportation providers, tour operators, and other suppliers that may not allow King’s Leisure & Travel to recover funds after travel arrangements have been secured. These policies allow King’s Leisure & Travel to maintain competitive package pricing and provide travelers with installment-payment options.

Travelers are strongly encouraged to purchase travel insurance to protect their financial investment.

FINAL PAYMENT: All reserved travel arrangements must be paid in full on or before the applicable final payment date. Your travel proposal, booking page, itinerary, or invoice will state the date your final payment is due.

Any reservation not paid in full on or before the final payment date is subject to cancellation without additional notice and without refund of payments previously made.

REINSTATEMENT OF RESERVATION: If your travel reservation has been canceled and you notify King’s Leisure & Travel within 14 days that you would like to request reinstatement, a $250 reinstatement fee will be added to your reservation and must be paid before King’s Leisure & Travel attempts to reconfirm the canceled services.

Payment of a reinstatement fee does not guarantee that previously reserved space, accommodations, airfare, pricing, or other travel components remain available. Any additional supplier fees or price increases will be the responsibility of the traveler.

LAST-MINUTE RESERVATIONS: Unless otherwise stated, reservations should be made no later than 60 days prior to departure. If requested services cannot be confirmed, payments made specifically for those unconfirmed services will be refunded. If the requested services are confirmed, final payment may be due within 24 hours and all applicable cancellation penalties will apply.

FORM OF PAYMENT: King’s Leisure & Travel accepts major credit and debit cards, including American Express, Discover, Mastercard, and Visa.

NAME CHANGES: Travelers are responsible for providing accurate legal names when making reservations. Name changes resulting from incorrect information provided by the traveler will incur a $200 per-person King’s Leisure & Travel revision fee, plus any additional supplier-imposed fees.

Name changes to airline reservations may require cancellation and rebooking and are subject to current availability and pricing. Replacing one traveler with another traveler constitutes a cancellation and new booking and is subject to applicable cancellation penalties. Changes made after departure are subject to local rates and supplier availability. There are no refunds for unused services.

CANCELLATIONS: Once reservations have been made, cancellation requests will only be accepted in writing. Cancellation requests must be emailed to [email protected] and should include the traveler’s invoice or reservation number, full name, and travel dates.

Once the cancellation request has been received, King’s Leisure & Travel may require completion of a cancellation request form before the cancellation process is complete. If you do not receive an acknowledgment within 48 hours, please contact King’s Leisure & Travel at 843-597-8646 to confirm receipt.

AGENCY-INITIATED POSTPONEMENT OR RESCHEDULING: King’s Leisure & Travel may postpone, reschedule, relocate, modify, or replace a trip due to participation levels, supplier changes, operational needs, safety concerns, force majeure, or other circumstances affecting the trip.

A postponement or rescheduling is not a cancellation. Payments remain non-refundable and will be applied to the revised trip.

If a traveler cannot attend the revised dates, King’s Leisure & Travel may issue a non-cash travel credit toward another eligible trip. Unless otherwise stated in writing, travel using the credit must be completed within 12 months from the date the credit is issued.

Travel credits are non-refundable, have no cash value, are subject to availability, are subject to any price difference, and are subject to the Terms & Conditions of the replacement trip. Any unused credit expires after the applicable validity period.

Only written announcements issued directly by King’s Leisure & Travel are considered official communications concerning the postponement, rescheduling, relocation, modification, replacement, or cancellation of a trip.

CHARGEBACKS: By submitting payment, the traveler authorizes King’s Leisure & Travel to charge the approved payment method for the agreed amount subject to these Terms & Conditions.

Before filing a payment dispute or chargeback with a bank or card issuer, travelers are asked to contact King’s Leisure & Travel at 843-597-8646 or [email protected] so that King’s Leisure & Travel may attempt to resolve the matter directly.

If a payment is reversed, withheld, or charged back, the related reservation may be placed on hold or canceled. A payment reversal or chargeback does not eliminate any balance otherwise lawfully owed under these Terms & Conditions.

King’s Leisure & Travel reserves the right to permanently decline future bookings from travelers who initiate a chargeback or payment dispute.

TRAVEL INSURANCE

TRAVEL INSURANCE: Missing a trip is disappointing. Losing the money invested in that trip can make the situation even more difficult. For this reason, King’s Leisure & Travel strongly recommends that all travelers purchase travel insurance.

Depending on the policy selected, travel insurance may provide benefits for covered circumstances involving trip cancellation, trip interruption, medical emergencies, baggage loss, travel delays, and other covered events.

Travelers are responsible for selecting and purchasing travel insurance appropriate for their individual needs.

DECLINING TRAVEL INSURANCE: Travelers who decline travel insurance acknowledge that their travel investment may not be protected if they are unable to travel or if an unexpected circumstance occurs. King’s Leisure & Travel will not be held responsible for additional costs, fees, penalties, or financial losses resulting from a traveler’s decision not to purchase travel insurance.

TRAVEL INSURANCE CLAIMS: King’s Leisure & Travel does not submit insurance claims on behalf of travelers and does not determine whether a claim will be approved or denied. King’s Leisure & Travel may provide documentation reasonably necessary for the traveler to submit a claim. All claim determinations are made by the applicable insurance provider.

GROUP TRAVEL

AFFINITY GROUP: King’s Leisure & Travel provides travel accommodations and services for private and affinity groups. Group Leaders may enter into a separate Group Leader Agreement detailing the group’s rights and responsibilities.

These Terms & Conditions are incorporated into applicable Group Leader Agreements and apply to all travelers participating in the group. If these Terms conflict with a specific Group Leader Agreement, group itinerary, or trip-specific contract, the applicable trip-specific agreement may control.

SPONSORED OR HOSTED GROUPS: King’s Leisure & Travel may sponsor or host group travel experiences. These trips may include additional amenities such as ground transportation, meals, events, excursions, activities, gifts, or other inclusions.

Additional terms may be included in the applicable booking page, itinerary, Passenger Agreement, invoice, or other trip-specific documentation.

ROOMMATE MATCHING: Roommate matching may be available on select King’s Leisure & Travel sponsored or hosted international trips. Travelers participating in roommate matching may be matched approximately 45 days prior to departure.

If a suitable roommate is not available by the applicable matching deadline, the traveler may be required to pay the single supplement or cancel subject to the trip’s applicable cancellation terms.

Travelers who participate in roommate matching agree to share accommodations for the duration of the trip. Any conflicts between matched travelers should be resolved appropriately between the travelers.

If matched travelers experience a conflict that cannot be resolved and separate accommodations become necessary, each affected traveler will be personally responsible for obtaining and paying for their own separate accommodations. King’s Leisure & Travel will not be responsible for additional accommodation expenses resulting from roommate disputes.

HOTEL & CRUISE PROFILES: King’s Leisure & Travel hotel, resort, and cruise ship profiles are based on information supplied by hotels, cruise lines, suppliers, and their representatives, including photographs, descriptions, and amenities.

Star ratings and classification systems may vary from country to country. King’s Leisure & Travel makes reasonable efforts to maintain current information but is not responsible for inaccuracies, changes in descriptions, changes in amenities, or images supplied by third parties.

TRANSFERS: Transfers will be provided only when specifically indicated as part of the applicable travel package.

Travelers purchasing land-only arrangements, arriving outside designated travel dates, departing outside designated travel dates, or making independent flight arrangements may be responsible for arranging their own transportation.

Transfer providers may maintain a limited waiting period based on scheduled arrival times. If a traveler experiences a significant delay due to airline operations, immigration, customs, baggage issues, or another circumstance, the traveler may be responsible for arranging alternate transportation at their own expense.

Unused transfer services and additional transportation expenses are non-refundable unless otherwise stated.

LUGGAGE – ESCORTED TOURS: Unless otherwise stated, escorted tour buses permit one piece of luggage per traveler plus one carry-on item. Additional baggage may be subject to an additional handling charge.

King’s Leisure & Travel is not responsible for loss of or damage to luggage or personal belongings. Loss or damage should be immediately reported to the applicable carrier, supplier, hotel, or local authority for documentation.

SIGHTSEEING & ITINERARY: King’s Leisure & Travel group trips may be designed to accommodate solo travelers as well as travelers attending with friends or family. Some itineraries may include early departure times, extended touring periods, walking, or other scheduled activities.

Travelers are responsible for arriving on time for all flights, cruises, transfers, excursions, and other scheduled trip components.

Travelers are not required to attend every included activity unless otherwise stated. However, travelers who choose not to participate in an included activity will not receive a refund for that unused service.

Late arrival may be considered a no-show and may result in forfeiture of the applicable service.

Scheduled itineraries may change because of holidays, local closures, weather, operating conditions, renovations, government restrictions, safety concerns, supplier changes, or unforeseen circumstances. King’s Leisure & Travel reserves the right to adjust the timing, order, location, or components of the itinerary when reasonably necessary. Such changes do not automatically entitle travelers to a refund or price adjustment.

Suggestions for activities during unscheduled leisure time do not constitute an endorsement or guarantee by King’s Leisure & Travel of any independent service provider.

TIPPING – ESCORTED TOURS: Unless gratuities are specifically included in the applicable package, suggested gratuities for drivers are generally $5 to $10 per traveler, per day, and suggested gratuities for tour guides are generally $10 to $20 per traveler, per day.

GROUP HARMONY: To help maintain a safe and enjoyable group environment, King’s Leisure & Travel reserves the right to accept, reject, remove, or expel any traveler who is considered disruptive or incompatible with the interests and safety of the group.

This may include travelers who are excessively intoxicated, under the influence of illegal drugs, fighting, stealing, harassing others, engaging in threatening or abusive behavior, violating local laws, or failing to follow reasonable rules established by King’s Leisure & Travel, the hotel, resort, cruise line, activity provider, or other supplier.

Expenses associated with removal from the group, including cancellation fees, alternate accommodations, airline changes, transportation, or transportation home, will be the responsibility of the traveler and their traveling companions. All unused services are non-refundable.

AIRLINE ACCOMMODATIONS

AIRLINES: King’s Leisure & Travel is not responsible for services or policies imposed by airlines. Airline schedules and flights are subject to change without notice.

King’s Leisure & Travel is not responsible for penalties associated with airline tickets purchased independently by travelers. Airline reservations included in a King’s Leisure & Travel package may be reviewed and adjusted when necessary to meet applicable connection requirements or package itinerary requirements.

Airlines reserve the right to require immediate issuance of tickets. If an airline requires earlier-than-expected ticketing, King’s Leisure & Travel may require immediate and full payment for the airfare regardless of the original invoice due date.

If required airfare payment is not received, airline space may be canceled and may not be available to rebook at the same price.

AIRLINE TICKETS: Airline tickets issued through King’s Leisure & Travel are generally issued electronically and are fully non-refundable once issued unless otherwise stated by the applicable airline.

AIRLINE SEAT ASSIGNMENTS: Airlines maintain sole authority over seat assignments. King’s Leisure & Travel cannot guarantee seat numbers, seat locations, or that travelers will be seated together.

King’s Leisure & Travel group airline contracts may be limited to economy-class accommodations unless otherwise stated.

AIRLINE FREQUENT FLYER PROGRAMS: Travelers are responsible for contacting their airline directly concerning mileage eligibility and accrual.

Discounted, promotional, private, group, and codeshare fares may not qualify for full mileage. Providing a frequent-flyer number to King’s Leisure & Travel does not guarantee that mileage will be awarded.

AIRLINE NAME CHANGES: Airline name changes, including minor spelling corrections, may require cancellation and rebooking of the airline reservation.

Reservations are subject to availability and current pricing at the time of rebooking. Once airline tickets have been issued, name corrections may result in airline penalties up to the full value of the airline ticket, plus any applicable King’s Leisure & Travel revision fee.

King’s Leisure & Travel is not responsible for denial of services by an airline because of a discrepancy between the traveler’s identification and airline reservation.

AIRLINE TAXES & FUEL SURCHARGES: Before airline tickets are issued, government taxes, fees, and fuel surcharges may increase. Travelers are responsible for applicable increases incurred before ticket issuance.

Once tickets are issued, they are subject to the applicable airline’s refund and change policies.

SCHEDULE CHANGES: In the event of an airline schedule change, King’s Leisure & Travel will make reasonable efforts to inform affected travelers of the change before departure.

King’s Leisure & Travel is not responsible for airline schedule changes, routing changes, connection changes, equipment changes, seat assignment changes, delays, or cancellations.

Travelers who independently modify their airline reservations are responsible for providing King’s Leisure & Travel with updated flight information. King’s Leisure & Travel is not responsible for missed transfers or other land services when flight changes are made without our knowledge.

TRAVELER PROGRAMS: Travelers are responsible for ensuring that TSA PreCheck, Global Entry, Known Traveler Numbers, or similar traveler-program information appears correctly on their airline reservations.

King’s Leisure & Travel does not administer these programs and does not determine eligibility.

LUGGAGE – AIRLINES: Airlines determine their own baggage allowances and fees. Travelers are responsible for reviewing the baggage rules applicable to their airline.

King’s Leisure & Travel is not responsible for checked-bag fees, excess luggage charges, overweight luggage charges, delayed baggage, lost baggage, or damaged baggage.

Lost or damaged baggage should be reported directly to the airline before leaving the airport.

HOTEL ACCOMMODATIONS

HOTEL ACCOMMODATIONS: Hotel room configurations, bedding, room locations, views, connecting rooms, and other requests are subject to availability and the discretion of hotel management.

King’s Leisure & Travel may submit special requests on behalf of travelers but cannot guarantee requests unless specifically confirmed in writing by the supplier.

Room sizes, configurations, hotel services, amenities, and operating standards may differ by hotel, destination, and country.

Hotel check-in is generally not before approximately 3:00 p.m. and check-out is generally before noon, although individual property policies may vary.

Travelers arriving substantially before check-in or departing substantially after check-out are responsible for making any additional accommodation arrangements they may require.

King’s Leisure & Travel reserves the right to substitute hotels with accommodations of a comparable standard when circumstances require. There will be no refund solely because a replacement property has a different supplier cost.

MEALS: Unless otherwise stated, travelers are responsible for meals, beverages, and personal expenses not expressly included in their travel package.

King’s Leisure & Travel cannot guarantee special dietary requests but will make reasonable efforts to communicate dietary requirements submitted in writing at least four weeks prior to departure.

CRUISES

SHIP & ITINERARY CHANGES: Cruise ships, itineraries, ports of call, schedules, and departure dates are subject to change without notice at the discretion of the cruise line.

King’s Leisure & Travel is not responsible for ship substitutions or itinerary changes imposed by a cruise line.

If a sailing is canceled or a ship is chartered, refunds or credits will be governed by the applicable cruise line’s policies.

King’s Leisure & Travel is not responsible for consequential losses resulting from cruise-line changes, including independent airfare, visa expenses, hotels, transportation, or other independently purchased services.

MEDICAL SERVICES: Medical services and facilities vary by cruise ship. If medical attention is required, the traveler is responsible for all resulting charges. King’s Leisure & Travel is not responsible for the availability, quality, cost, or outcome of medical services provided aboard a vessel or at a destination.

HEALTH & SAFETY

MEDICAL SERVICES: Travelers may occasionally require medical attention while traveling. When medical attention is required, travelers are responsible for contacting appropriate local providers and paying all associated costs.

King’s Leisure & Travel is not responsible for services provided by independent medical providers. Travel insurance that includes appropriate medical coverage is strongly recommended.

HEALTH REQUIREMENTS: Travelers are responsible for ensuring that they meet the health requirements of their destination.

Required vaccinations, testing, certificates, health forms, or other documentation must be obtained by the traveler where applicable. Travelers should review current government and public-health guidance before departure.

SPONSORED TRIP ILLNESS: Travelers with preexisting health conditions should consult their healthcare provider before securing travel when appropriate.

A traveler who arrives at a destination visibly ill or becomes seriously ill during a hosted or group experience may be required to obtain medical evaluation before continuing to participate in group activities.

All costs associated with medical treatment, transportation, additional hotel nights, or other expenses resulting from illness will be the responsibility of the traveler.

TRAVELING WHILE ILL: Any traveler who becomes ill while traveling should seek appropriate medical attention.

King’s Leisure & Travel will not be responsible for costs associated with illness, medical treatment, additional accommodations, quarantine, airline changes, transportation, missed services, denied boarding, or trip extensions.

King’s Leisure & Travel may make reasonable efforts to assist travelers with changes to travel arrangements, but all resulting expenses remain the traveler’s responsibility unless otherwise covered by an applicable insurance policy or supplier.

TRAVELERS WITH DISABILITIES

TRAVELERS WITH DISABILITIES: King’s Leisure & Travel wants travelers to enjoy their travel experiences and understands that travelers may have different accessibility needs.

Travelers requiring physical assistance or accommodations for mobility, sight, hearing, or other accessibility needs should notify King’s Leisure & Travel prior to booking whenever possible.

King’s Leisure & Travel may review the itinerary and physical requirements with the traveler but cannot guarantee that every destination, hotel, cruise ship, tour, activity, or transportation provider can accommodate every accessibility requirement.

Travelers who require personal assistance must travel with an individual responsible for providing that assistance. Tour managers, guides, drivers, hotel employees, cruise personnel, and other suppliers may not be able to provide individualized personal assistance.

WHEELCHAIRS, WALKERS & SCOOTERS: Certain itineraries, activities, vehicles, hotels, cruise ships, or destinations may not be able to accommodate wheelchairs, walkers, scooters, or other mobility devices.

Hotels, cruise ships, transportation providers, and other suppliers outside the United States may not be subject to U.S. ADA requirements.

Travelers are responsible for confirming that their accessibility requirements can be accommodated.

SERVICE ANIMALS: Travelers who require a service animal should contact King’s Leisure & Travel prior to booking.

Travelers are responsible for complying with all airline, hotel, cruise line, destination, government, health, and importation requirements relating to service animals. Acceptance of service animals outside the United States varies and cannot be guaranteed by King’s Leisure & Travel.

RELEASE FROM LIABILITY

King’s Leisure & Travel, its shareholders, directors, officers, employees, and affiliates do not own or operate the hotels, lodging facilities, airlines, vessels, transportation companies, local ground operators, excursion providers, equipment providers, restaurants, food-service providers, entertainment providers, or other third parties that provide goods or services in connection with a traveler’s trip.

All such persons and entities are independent contractors.

King’s Leisure & Travel is therefore not liable for the negligent or intentional acts or failures to act of such independent contractors or other third parties.

To the fullest extent permitted by applicable law, King’s Leisure & Travel is not responsible for injury, illness, death, property loss, property damage, delay, inconvenience, or other losses resulting from acts of God, acts of government, war, civil unrest, strikes, criminal or terrorist activities, supplier overbooking, accommodation changes, structural defects, transportation failures, transportation delays, animals, insects, marine life, vegetation, recreational activities, sanitation issues, foodborne illness, limited medical care, evacuation difficulties, illness, epidemics, pandemics, or other causes beyond the direct control of King’s Leisure & Travel.

Travelers acknowledge that travel inherently involves risk and agree to assume such risks to the fullest extent permitted by law.

FORCE MAJEURE

There may be times when either party is unable to perform or complete performance under a travel agreement because of circumstances outside the reasonable control of the affected party.

Force majeure events may include acts of God, government action, war, civil unrest, insurrection, military action, strikes, labor activities, criminal or terrorist activity, pandemics, epidemics, widespread illness, earthquakes, hurricanes, severe weather, lightning, explosions, unexpected legislation, government restrictions, or other circumstances outside the reasonable control of the parties.

If a force majeure event occurs, King’s Leisure & Travel will look to the applicable supplier policies, trip-specific terms, travel proposal, and these Terms & Conditions to determine the available options.

Changes to supplier policies remain within the applicable supplier’s discretion. King’s Leisure & Travel will communicate available options to affected travelers when reasonably possible.

TRAVEL & COMMUNICABLE ILLNESS

Travel may involve potential exposure to communicable illnesses, including COVID-19 and other infectious diseases.

Governments, airlines, cruise lines, hotels, resorts, transportation providers, tour operators, and other suppliers may establish health and safety requirements that change before or during travel.

King’s Leisure & Travel does not create or control government or supplier health policies and cannot guarantee how those policies will be implemented or enforced.

Travelers are responsible for reviewing and complying with all health, testing, vaccination, quarantine, and entry requirements applicable to their destination and travel suppliers.

Travelers may be denied entry, denied boarding, quarantined, delayed, or otherwise affected by public-health restrictions.

Travelers acknowledge and voluntarily assume the risks associated with travel and communicable illness to the fullest extent permitted by law.

ASSUMPTION OF RISK

Travel may involve hazardous activities and risks of illness, injury, property loss, or death.

Risks may arise from weather, natural conditions, animals, insects, plants, transportation, recreational activities, third parties, limited access to medical services, or other circumstances.

By participating in travel arranged through King’s Leisure & Travel, travelers acknowledge and voluntarily accept the inherent risks associated with travel.

Travelers are responsible for understanding the physical requirements of activities in which they choose to participate and for determining whether they are physically capable of participating.

When reasonably necessary and the traveler is unable to provide further consent, the traveler authorizes King’s Leisure & Travel, its local ground operator, or other appropriate parties to arrange emergency medical treatment or hospitalization.

BINDING ARBITRATION, GOVERNING LAW & VENUE

Any dispute, claim, or controversy concerning, relating to, or referring to these Terms & Conditions, any travel agreement, brochure, itinerary, travel literature, or the trip itself shall be resolved exclusively through binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§ 1–16.

Arbitration may proceed according to the then-existing Commercial Rules of the American Arbitration Association or the Comprehensive Arbitration Rules & Procedures of Judicial Arbitration and Mediation Services, Inc.

Proceedings shall be governed by the substantive laws of the State of South Carolina, without regard to its conflict-of-law rules, and shall take place in Charleston County, South Carolina.

The arbitrator shall have authority to resolve disputes involving the interpretation, applicability, enforceability, or formation of these Terms & Conditions.

By agreeing to these Terms & Conditions, the traveler and King’s Leisure & Travel knowingly waive the right to a trial by jury and the right to participate in a class action lawsuit.

Any claim or cause of action must be filed within one year of the incident giving rise to the claim or shall be forever barred to the extent permitted by applicable law.

VOLUNTARY PARTICIPATION

Travelers acknowledge that they have voluntarily chosen to participate in the travel experience described in their travel proposal, booking page, itinerary, or other travel materials.

Travelers acknowledge that they have reviewed the description of the trip and voluntarily participate with knowledge of the risks involved.

KNOWING & VOLUNTARY EXECUTION

Travelers acknowledge that they have carefully read these Terms & Conditions and their applicable trip information and understand the contents, including applicable payment policies, cancellation provisions, releases of liability, assumption-of-risk provisions, and arbitration requirements.

By submitting a deposit or other payment, travelers agree to these Terms & Conditions for themselves and, where legally authorized, members of their traveling party and accompanying minor children.

PASSENGER AGREEMENT

All travelers may be required to complete a Passenger Agreement prior to travel and, by doing so, formally accept King’s Leisure & Travel’s Terms & Conditions.

Travel documents may not be released without a completed Passenger Agreement.

King’s Leisure & Travel reserves the right to cancel bookings when a required Passenger Agreement has not been completed.

The Passenger Agreement incorporates these Terms & Conditions, including applicable Release from Liability, Assumption of Risk, and Binding Arbitration provisions.

Completion of a Passenger Agreement constitutes acceptance of these Terms & Conditions.

ELECTRONIC SIGNATURES

By submitting payment, completing a Passenger Agreement, electronically signing a document, or checking an online acceptance box, travelers acknowledge and agree that their electronic acceptance constitutes their signature and demonstrates their intent to be legally bound.

To the fullest extent permitted by applicable law, electronic acceptance will have the same legal effect and validity as a handwritten signature.
